This document is being finalised with our advocate and may change. Items shown [in brackets] are still being confirmed. Your written quote sets out the terms that apply to your booking. Questions? Email info@creekstours.com.
1. Our role
1.1 Creeks Tours ordinarily organises the combination of services identified in the accepted Quote. We may use Suppliers to perform accommodation, transport, guiding, flights, permits, activities or other parts. Subcontracting does not by itself remove a responsibility the contract or law places on us.
1.2 Where we act only as agent for a clearly identified standalone service, the Quote will say “agent”, identify the principal Supplier and provide or link its material terms before Booking. The service contract is then between the Traveller and that Supplier, while we remain responsible for our own booking service, representations and handling of money.
2. Supplier terms and standards
2.1 Airlines, park authorities, permit issuers, insurers and accommodation providers may impose lawful conditions on schedules, baggage, check-in, conduct, refunds, safety, age, health, transfers and cancellations. A Supplier term binds a Traveller only where properly incorporated and not overridden by mandatory law or our express promise.
2.2 Standards, star ratings, facilities, vehicles and infrastructure vary by country and location. Descriptions are assessed against the destination context, not necessarily the Traveller’s home-country standard.
3. Changes and defaults
3.1 We use reasonable care in selection and contracting and will assist if a Supplier fails. Remedies depend on our role, the cause, reasonable mitigation, recoveries and applicable law. We are not liable merely for an event wholly outside our control, but we do not exclude liability for negligent selection, our own misrepresentation or a statutory organiser duty.
3.2 Supplier insolvency risk and any customer-money or insolvency protection are described as [Customer money protection arrangements]. Do not assume a credit-card chargeback, trade-association membership or insurance applies unless confirmed.
4. Airlines and international conventions
4.1 Air carriage is subject to the carrier’s conditions and applicable international conventions and laws. Flight times may change. We do not override a carrier’s lawful liability limit, but any compensation received for the same loss will be credited to prevent double recovery.
5. Overseas package-travel laws
5.1 The Booking is governed by Kenyan law, but that choice does not remove mandatory protections that apply because we direct sales to, conclude a contract with, or otherwise fall within the law of a Traveller’s country. EU or UK package-travel rules and US state seller-of-travel laws may apply depending on how and where a Trip is marketed and sold.
