1. About these terms
1.1 These terms govern use of creekstours.com (the Website). Creeks Tours, we or us means Creeks Tours and Travel Limited, trading as Creeks Tours & Travel. You means a Website visitor.
1.2 Using the Website means you accept these terms. An enquiry is not a Booking. A Booking is formed only as stated in Booking Terms & Conditions for Tours and Safaris.
2. Information, itineraries and prices
2.1 Website itineraries, dates, availability, accommodation descriptions, images, wildlife references and “from” prices are general planning information, not a binding offer. Wildlife sightings, weather, road conditions and exact timings cannot be guaranteed.
2.2 A personalised written quote identifies the proposed services and price. If Website content conflicts with an accepted quote, the accepted quote controls for that Booking, followed by Booking Terms & Conditions for Tours and Safaris and any signed special terms.
2.3 We take reasonable care but do not promise that the Website is uninterrupted, error-free or always current. Tell us about a suspected error at info@creekstours.com.
3. Acceptable use
3.1 You must not misuse the Website, attempt unauthorised access, introduce malicious code, scrape it at a rate that harms service, bypass security, submit false or unlawful content, impersonate another person, infringe rights, or use contact channels for spam.
3.2 We may block abusive access, preserve evidence and report suspected unlawful conduct.
4. Intellectual property
4.1 Unless stated otherwise, we or our licensors own the Website’s design, text, brand assets, photographs, PDFs and other content. You may view, download a trip PDF and share an unmodified link or copy for personal trip planning. No commercial reproduction, republication, resale, model training, brand use or creation of derivative material is permitted without written consent.
4.2 If you submit feedback or non-confidential suggestions, you grant us a worldwide, non-exclusive, royalty-free licence to use them to improve our services. Identifiable testimonials and traveller media require the separate Photo, Video & Testimonial Release.
5. Third-party links
5.1 Links are provided for convenience. We do not control third-party sites and do not endorse every statement, product or security practice on them. Check the relevant terms before using WhatsApp, social media, immigration, insurance or supplier sites.
6. Liability
6.1 Nothing in these terms excludes liability that applicable law does not permit us to exclude, including liability for fraud or fraudulent misrepresentation, or limits mandatory consumer remedies.
6.2 To the extent permitted by law, we are not liable for losses caused solely by reliance on general Website content instead of an accepted written quote, for third-party sites, or for indirect business losses not reasonably foreseeable from personal Website use.
7. Availability, changes and takedown
7.1 We may maintain, suspend, withdraw or change the Website. We may correct an obvious error before a Booking is formed. Changes do not retrospectively alter an accepted Booking except as the Booking Terms permit.
7.2 To report unlawful, infringing, inaccurate or privacy-invasive material, email info@creekstours.com with the URL, issue, your contact information and supporting evidence. We will acknowledge within one working day and investigate proportionately.
8. Law
8.1 Kenyan law governs these Website terms. The dispute steps in Complaints & Dispute Resolution Procedure apply. Mandatory consumer rights and the jurisdiction of a competent regulator or court are preserved.
